  38. This produces a messy roof and a serious hazard to parked cars, cats and 
  39. small children on the ground :-)

  41. Also, however, the elements have been getting torqued seriously out of 
  42. plane by the weight of the lil' chirpers. They seem not to have an eye 
  43. for symmetry and apparently don't understand about balanced loads, 
  44. balanced feed lines, or the like.
  45.  
  46. I understand that the above puns probably have you reaching for your KILL 
  47. file now, so enough mirth.
  48.  
  49. Can anyone tell of similar experiences and how the problem was cured? I 
  50. have contacted a local sporting goods company and they have plastic owl 
  51. decoys...I am going to try one of those, I guess. The work of cranking 
  52. down the tower, bringing the antenna to the ground, realigning the 
  53. elements and putting it all back up again is depressing to contemplate.

  55. What about drilling a hole through the beam and the element, to augment 
  56. the anti-twisting action of the U-bolt?

  142. out there?  I love to speculate (the less you know, the more you guess) but
  143. I would like to know for sure what kind of things kick into action when
  144. something like that strikes.

  230. THE DIVISION'S DURAL STATION CLOSED
  231.  
  232. Two recent events have brought about the closure of the Division's
  233. Dural station.
  234.  
  235. On Friday, December 31st, the Division was served with a letter from
  236. Solicitors Marshall Marks Kennedy, acting for Ms Val Bergman.
  237.  
  238. The letter alleged that she was seriously affronted by two packet radio
  239. bulletins which named her, transmitted to the Division's Bulletin Board
  240. VK2RWI on the 28th of December under the callsign of David Horsfall
  241. VK2KFU.
  242.  
  243. The solicitor's letter also alleged that these two bulletins were part
  244. of a series and that she believed she was being harassed by Mr
  245. Horsfall.
  246.  
  247. We must point out at this stage that Val Bergman is married to the
  248. Divisional Secretary, Roger Harrison.
  249.  
  250. In addition, the solicitor said that the bulletins were defamatory of
  251. her and pointed out that, under the Radiocommunications Act, the
  252. Division's station licence was subject to a condition that th station
  253. could not be operated, or permitted to be operated, in such a manner.
  254.  
  255. The Division was given until 5.00 pm on Friday the 7th of January to
  256. undertake to prevent such transmissions via the VK2RWI BBS in the
  257. future, or else the Division may receive an injunction to stop its
  258. operation. In addition, an action seeking damages for defamation was
  259. threatened.
  260.  
  261. This action is very serious indeed, not only for the Division, but
  262. consequently for all packet radio BBS operators, users of packet radio
  263. and the entire amateur radio service.
  264.  
  265. The point is that the Division, and any packet BBS operator, is a
  266. "knowing publisher" of whatever is posted to the packet BBS. Anyone who
  267. may be knowingly involved in the publication of defamatory material can
  268. be enjoined in a defamation action. And juries in recent defamation
  269. cases in NSW have awarded astonishingly high sums in damages.
  270.  
  271. This resulted in a decision to take the VK2RWI packet BBS off-air for
  272. the time being. Vice-President John Robinson VK2XY handled this legal
  273. business for the Division as Secretary Roger Harrison declined owing to
  274. his relationship with Val Bergman.
  275.  
  276. As if that weren't serious enough for the Division, on Sunday morning
  277. the 2nd of January, there was a broadcast made from Dural, which was
  278. purported to be an "official" broadcast. The text of that broadcast was
  279. also transmitted as a series of  bulletins to the packet radio network
  280. under the callsign of VK2WI.  These voice and packet broadcasts were
  281. unauthorised and contain material which is untrue.
  282.  
  283. In view of these serious events, and following considerable discussion
  284. among the President, Vice-President, Secretary, and two other
  285. Councillors, being a majority of the Council including the executive,
  286. the Institute's packet radio bulletin board system VK2RWI, was taken
  287. off the air on Sunday 2nd January 1994 and the equipment dismantled and
  288. removed from the Institute's property at 63 Quarry Rd, Dural.
  289.  
  290. In addition, the other transmitting equipment at Dural has been secured
  291. against unauthorised use and the building secured against unauthorised
  292. entry by other persons. A notice detailing the closure of the station
  293. has been posted on the door of the building, and the same notice has
  294. been transmitted to the packet radio network in New South Wales.  The
  295. Division's solicitors have advised that the station closure was an
  296. appropriate action in view of all the circumstances which, apart from
  297. the action over the packet BBS, involved breach of the Division's
  298. station licences.
  299.  
  300. Those involved in the unauthorised broadcast of the 2nd of January
  301. include:  Councillor Cesar Miranda VK2TCM, Steve Pullan VK2QZ and David
  302. Horsfall VK2KFU.
  303.  
  304. However, yesterday afternoon, the VK2RWI voice repeater was restored to
  305. operation for the use of WICEN in support of bushfire operations around
  306. Sydney.
  307.  
  308.  
  309. DIVISIONAL NEWS.
  310.  
  311. Council, or at least the majority of Council, regrets that the actions
  312. of a few have disadvantaged the majority of members.
  313.  
  314. A major goal of most of those elected to this Council last May was to
  315. clean up the Division's operations, policies and procedures; to put the
  316. Division on a proper footing in all aspects of its operations.
  317.  
  318. It is very sad for the Institute that we have been forced to take these
  319. steps owing to the acts of people who, for quite erroneous reasons,
  320. believe that they have rights superior to the other members of the
  321. Institute and superior to the management of the Division, which is a
  322. company.
  323.  
  324. This Council has had to battle many such acts by some members and,
  325. worse still, some Councillors, since the AGM last May, and it has
  326. continued despite the caution about acting within the law President
  327. Terry Ryeland gave to people in his speech on the last broadcast for
  328. 1993 on December the 19th, and his plea for reason and sanity to
  329. prevail.  They should heed not just the law, but the spirit of The
  330. Amateur's Code.  The actions of just a small group of people, including
  331. some Councillors, have virtually hijacked the business of the Council
  332. and simply wasted the resources of the Division, the efforts of
  333. volunteers and interfered with the proper management of the Division -
  334. all without a skerrick of mandate from the membership.
  335.  
  336. It's time it ceased.  
  337.  
  338. Honourable people offer assistance to the Division when the
  339. organisation needs it, not interference with its business. Thanks must
  340. go to those Councillors and volunteers who maintain the Division's
  341. operations for the benefit of the whole membership.
  342.  
  343. The agreement which was drawn up at the recent ATV forum, held on the
  344. 17th of December was delivered to Council by Peter O'Connell VK2EMU,
  345. who chaired that forum. Council discussed aspects of the agreement
  346. which has been referred to the new Technical Advisory Committee.
  347.  
  348. Council noted a letter of resignation from the broadcast coordinator,
  349. Steve Pullan VK2QZ.
  350.  
  351. The broadcast team and arrangements for broadcasts are to be
  352. re-formed.  Broadcast team members will be advised this coming week.
  353.

  357. Message from the President Terry Ryeland VK2UX.
  358.  
  359. "The efficient conduct of the Division's business is being adversely
  360. affected ......... and I call upon ALL COUNCILLORS  -  AND all
  361. Divisional volunteer workers  -  to bear in mind the interests of the
  362. members and the Division. They come first.
  363.  
  364. "In taking up our positions, we all owe a duty to the Division and the
  365. members, and we should not allow any dispute or difference of view or
  366. opinion to affect the discharge of those duties.
  367.  
  368. "I remind Councillors and Office Bearers that your actions are subject
  369. to the general law, including law relating to defamation.
  370.  
  371. "There are constructive ways to resolve differences, and that does not
  372. include the unruly disruption of Council meetings.
  373.  
  374. "Council meetings are the primary forum for conducting the Division's
  375. business. Let us get back to that business  -  the business of
  376. providing services to members and to the amateur radio community at
  377. large.
  378.  
  379. "Differences can be aired at private committee meetings. The resolution
  380. of conflict is best done through constructive action, not destructive
  381. disputes.
  382.  
  383. "Let us take this opportunity to take heed of the spirit of the season,
  384. and look to our duties and our differences and resolve to act in the
  385. interests of the members and the Division and to put value and pride in
  386. belonging to this could-be-great organisation."
  387.  
  388.  
  389. COUNCIL MEETING IN WOLLONGONG
  390.  
  391. Following a requisition by Councillor John Simon VK2XGJ, Council held a
  392. meeting on Tuesday January the 4th at Wollongong SES Headquarters.
  393.  
  394. John nominated the date, the time and the place of the meeting, as he
  395. is quite properly able to do under the Corporations Law. He was aware
  396. that the Institute has some deadlines to meet regarding the business of
  397. the Division and, with that in mind, requisitioned the meeting under
  398. Articles 29 and 30 of the Division's Articles of Association. Notices
  399. were posted on December the 29th.
  400.  
  401. On Friday, December 31st, the Division was served with a letter from a
  402. solicitor, John Gillmour, acting for Councillors Cesar Miranda VK2TCM,
  403. Roger Henley VK2ZIG and Bob Yorston VK2CAN.
  404.  
  405. The solicitor acting for these three Councillors sought to prevent the
  406. meeting going ahead.
  407.  
  408. The letter was referred to the Division's solicitors who replied,
  409. pointing out that the meeting was properly requisitioned, notices were
  410. properly served and the Council had urgent business to consider by or
  411. before that date.
  412.  
  413. An action to injunct the holding of the meeting, threatened by the
  414. solicitor for Councillors Miranda, Henley and Yorston, did not
  415. eventuate, and the meeting went ahead as planned.
  416.  
  417. Present were: Terry Ryeland VK2UX,
  418. John Simon VK2XGJ,
  419. John Robinson VK2XY,
  420. Julie Kentwell VK2XBR
  421. and Roger Harrison VK2ZTB.
  422.  
  423. Councillors Cesar Miranda VK2TCM, Roger Henley VK2ZIG and Tim Mills
  424. VK2ZTM were absent. No notification of their absence was lodged either
  425. at the Division or with the Secretary. Councillor Bob Yorston had
  426. notified his absence to the Division on the 21st of December.
  427.  
  428. There were 17 visitors present, coming from the Illawarra region, the
  429. South Coast, the Blue Mountains and Sydney.
  430.  
  431. Council first dealt with the business before the meeting adjourned from
  432. the 17th of December, which was requisitioned by Councillors Cesar
  433. Miranda VK2TCM, Roger Henley VK2ZIG, Bob Yorston VK2CAN and Tim Mills
  434. VK2ZTM.
  435.  
  436. That business involved a motion of no confidence in the Secretary Roger
  437. Harrison VK2ZTB and a motion seeking to dismiss him from all
  438. positions.  That meeting was adjourned by President Terry Ryeland when
  439. it became unruly.
  440.  
  441. The motion of no confidence was defeated by a vote of five-zero.  Terry
  442. Ryeland, on advice from Institute solicitor David Lewarne, ruled the
  443. motion to dismiss the Secretary out of order as it contravened Article
  444. 51 of the Division's Articles of Association.
  445.  
  446. The reasons for the no confidence motion and dismissal advanced by
  447. Councillors Henley and Miranda were found to be unsubstantiated.
  448.  
  449. Also, at the meeting of January 4th, Council set the date for the
  450. Extraordinary General Meeting which was requisitioned on the 5th of
  451. December.
  452.  
  453. The EGM will be held on Saturday the 26th of February, at the Doonside
  454. Community Centre, where the November EGM was held. It will open at 2.00
  455. pm, or 1400 hours local time. Official notice of the EGM will appear in
  456. the February issue of AR magazine.
  457.  
  458. Note that the 26th is the day before the Central Coast Field Day at
  459. Wyong.
  460.  
  461. Another important item on the agenda was the Division's insurances. The
  462. insurance schedule is to be referred to an assessor in order that all
  463. the values of property to be insured are up to date. Council is due to
  464. finalise choice of insurance broker and insurer at its meeting
  465. scheduled for the 21st of January.
  466.  
  467. Council noted a letter of resignation from the Chairman of the NSW
  468. Technical Advisory Committee, Cesar Miranda VK2TCM. In his letter, Mr
  469. Miranda alleged that Council was exercising too much control over
  470. NTAC.
  471.  
  472. Council, while accepting Mr Miranda's resignation, did not accept the
  473. reason.  It was pointed out that quite a number of applications
  474. regarding repeaters were waiting to be passed to Council for approval
  475. before sending to the SMA, some being outstanding for more than four
  476. months. It was also revealed that there were a series of letters of
  477. complaint to the Division from three affiliated radio clubs about
  478. inaction by NTAC.
  479.  
  480. Council pointed out that there were TEN Council meetings between the
  481. start of October and the end of December at which approvals could have
  482. been placed before Council. It was also pointed out that an NTAC Report
  483. is also on the standard agenda for each Council meeting, providing an
  484. opportunity for approvals to be passed by Council.
  485.  
  486. No action was taken by Cesar Miranda, the then Chairman of NTAC to put
  487. approvals before Council. Hence, his allegation of "control" of NTAC by
  488. the Council was rejected as untrue.
  489.  
  490. He did not submit approvals for the meeting of January the 4th.
  491.  
  492. As a result, Council then appointed John Simon VK2XGJ as Chairman of
  493. NTAC.  He was given the responsibility to obtain all outstanding
  494. repeater applications and all NTAC files, to find willing volunteers to
  495. serve as members of NTAC and to report to the Council meeting scheduled
  496. for the 21st of January.
  497.

  499. Telecom donates FM-828 transceivers to the VK2 Division.
  500.  
  501. On a  happier note, the donation of more than 500 FM828 VHF
  502. transceivers to the Division by Telecom was announced at Council's
  503. January 4th meeting in Wollongong.
  504.  
  505. The official handover took place on the 21st of December. Well-known
  506. amateur Dick Smith VK2DIK accepted the donation on behalf of the
  507. Division, from Mr Charles Zoi, manager of Telecom marketing in Sydney.
  508.  
  509. The ceremony took place at the headquarters of Australian Geographic in
  510. Terrey Hills. Vice-President John Robinson VK2XY and Secretary Roger
  511. Harrison VK2ZTB attended for the Division.
  512.  
  513. Council will determine the disposal of the FM828s at its meeting on the
  514. 21st of January.

  518.  
  519. As listeners may already be aware, WICEN has been active in providing
  520. support for bushfire fighting operations.
  521.  
  522. According to information gained earlier this evening, WICEN has been
  523. called out on the South Coast, in Sydney South, Sydney North, in the
  524. Hunter region and the Central Coast. Apparently, Mid-North Coast WICEN
  525. is on standby.

  527. State Emergency Services communications has failed in the Central Coast
  528. and WICEN has completely taken over communications for them.

  550. Summary of activity:  solar activity was low on New Year's eve, very
  551. low on New Year's day, high with an M-class solar flare on January
  552. the 2nd, and low on January the 3rd.  On January 4th, solar activity
  553. was again very low, rising to moderate on the 5th and returning to
  554. low on January the 6th.

  556. Ionospheric critical frequencies were enhanced by at least 15 per cent
  557. and up to 30 to 50 per cent from December 31st through to January 6th.
  558. Strong sporadic E was observed every day from December 31st through to
  559. January 4th.

  561. Forecast for the next week, 7 to 13 January is as follows:

  565. Geomagnetic activity  -  quiet with a possible active period on
  566. 12th-13th January. Ionospheric critical frequencies are expected to be

  600. You may have heard this, but it's wrong. The FT530 does not
  601. tx in AM.

  609. Besides beling illegal (which might make one a bit more circumspect)
  610. it is functionaly impossible with the FT530. This radio does not allow
  611. user selection of step rates in the 800-950Mc band. 12.5Kc is enforced
  612. and cannot be changed.
